The author has divided his book into three parts: the first of which is devoted to the biography of Sheikh “Muhammad al-Tahir Ibn Ashur,” his reform movement, and a discussion of his writings. The second is in line with the objectives of Shari’ah (Maqaasid Ash-Shari’ah), adding to it a set of fundamental studies due to the relationship between them. He detailed his method in a set of scholarly writings. The third: is a chapter on the Objectives of Shari’ah, which is distinguished by its issues and research. Thus, this book was written, i.e. (Maqaasid Ash-Shari’ah), and published, with an introduction and commentary, in the hope that it would be easy and accessible to the students, reviewers and scholars.
In his book, Ibn Ashur intended to study the objectives of Islam concerning the laws and rules governing civil transactions, etiquettes and morals. These laws deserve to be exclusively called the Shari’ah, for they reflect Islam’s aim to specify and identify the various levels of benefit (Masa’lih) and harm (Mafa’sid), and the criteria for assessing them, and this is a manifestation of the greatness of Islamic Shari’ah law, in contrast to the rest of the laws and social policies, for preserving world order and reforming society.
