Psychological Disorders and Their Impact on Responsibility in Islamic Jurisprudence and Secular Law by Dr Al-Husaini Arafat.
In the past, Islamic jurists were familiar with certain psychological disorders and would base legal rulings on them. However, as psychology has developed, psychological disorders have become more diverse, with varying degrees of impact on accountability and the capacity to bear responsibility.
The author sought to study these psychological disorders and their effects on legal responsibilities, eligibility, civil and criminal liability, and punishments from the perspective of Islamic jurisprudence and secular law. He categorizes these disorders into three types: those that completely negate legal capacity, those that partially reduce it, and those that have no effect on capacity.
This valuable book is an important study, much needed in our time, particularly in the judicial field.
