Ahkam Ahl adh-Dhimah - Ibn Qayyim al-Jawziyyah

Athar al-Imam Ibn Qayyim al-Jawziyyah - 8 to 12

This classic ibn al-Qayyim discusses of Fiqh, of Usool, of Maqasid al-Shari'ah and of Tarikh at-Tachri', of Siyasiya Shari'a...
It is a book that combines jurisprudence and its principles, the objectives of Shari’ah, the history of legislation and Islamic governance. In it, he urged to follow the Prophet’s traditions and produced clearly the sources of legislation. He explained Omar’s letter to Abu Musa al-Ash’ari, which is considered a source in providing proof and rulings in Islamic jurisprudence.
Then the author dealt with a detailed study of some jurisprudential and fundamentalist subjects, such as usury, blocking the means (to what is prohibited) and tricks (to bypass Shari’ah), analogy, interpretation, the conditions of a mufti, and the etiquettes of fatwa and the saying of Talaq (divorce) three times by the husband.
The book concluded with lengthy chapters on the fatwas of the Prophet, may Allah bless him and grant him peace, and arranged them according to the chapters of jurisprudence. The author discusses the issues at length and in detail, with argumentation, explanation and justification. He uses the style of guidance with good choice and preference, the strength of the character, and the extracting of Hadiths with their reference to their Sunnah books sources.
